There is perhaps no text with a broader impact on our lives than the 1948 Universal Declaration of Human Rights . It is strange, therefore, that historians have paid so little attention to the UDHR. I argue that its potential impact on the study of history is profound. After asking whether the UDHR contains a general view of history, I address the consequences of the UDHR for the rights and duties of historians, and explain how it deals with their subjects (...) of study. I demonstrate that the UDHR is a direct source of five important rights for historians: the rights to free expression and information, to meet and found associations, to intellectual property, to academic freedom, and to silence. It is also an indirect source of three duties for historians: the duties to produce expert knowledge about the past, to disseminate it, and to teach about it. I discuss the limits to, and conflicts among, these rights and duties. The UDHR also has an impact on historians’ subjects of study: I argue that the UDHR applies to the living but not to the dead, and that, consequently, it is a compass for studying recent rather than remote historical injustice. Nevertheless, and although it is itself silent about historians’ core duties to find and tell the truth, the UDHR firmly supports an emerging imprescriptible right to the truth, which in crucial respects is nothing less than a right to history. If the UDHR is a “Magna Carta of all men everywhere,” it surely is one for all historians. (shrink)

The abuse of history is common and quite possibly once more on the rise. Although this is well documented, there is no general theory that enables historians to identify, prove, explain, and evaluate the many types of abuse of history. In this book, the author presents such a theory. Reflecting on the responsible use of history, the author identifies the duties that the living has toward the dead and analyzes the rights to memory and history necessary to fulfill these duties. Defamation is the act of damaging another’s reputation. According to recent legal research, defamation laws may be improperly used in many ways. Some of these uses profoundly affect the historian’s work: first, when defamation laws protect reputations of states or nations as such; second, when they prevent legitimate criticism of officials; and, third, when they protect the reputations of deceased persons. The present essay offers two tests of these three abuses in legal cases where historians were defendants. The first test, (...) a short worldwide survey, confirms the occurrence of all three abuses; the second test from nine western European countries) the occurrence of the third abuse. Both tests touch on problems central to the historical profession: living versus deceased persons; facts versus opinions; legal versus historical truth; the relationship between human dignity, reputation, and privacy; the role of politicians, veterans, and Holocaust deniers as complainants; the problem of amnestied crimes. The second test—the results of which are based on verdicts, commentaries, and press articles, and presented in a synoptic table—looks closely into the complainants’ and defendants’ profiles, the allegedly defamatory statements themselves, and the verdicts. All statements deemed defamatory were about such contemporary events as World War II and colonial wars. Both tests amount to two conclusions. The first one is about historians’ professional rights and obligations: historians should make true, but privacy-sensitive or potentially offending, statements only when the public interest is served; otherwise, they should have a right to silence. The second conclusion concerns defamation itself: defamation cases and threats to sue in defamation have a chilling effect on the historical debate; they are often but barely veiled attempts at censorship. ABSTRACTThis essay investigates the thesis that inhumanity breeds humanity. Many questions arise when we try to corroborate it: Can we say anything at all about the inhumanity of human beings? Why did large‐scale inhumanity occurring before 1700 not elicit a human rights regime? Was the human rights take‐off from 1760 to 1800 triggered by instances of inhumanity, and why did the take‐off not last? Why did the human rights idea eclipse after 1800 only to reemerge after 1945? Were war and (...) genocide the sole causes of the human rights revival after 1945 or were there also other factors? Was the breakthrough in 1977 of human rights as a mass movement related to any inhumanity? And, finally, is the contemporary enthusiasm for human rights, with 1998 as its stepping stone, sufficient to make atrocities unthinkable for good? I conclude that, at several moments in history, inhumanity did propel humanity, but also that there are many other instances in which inhumanity only gave birth to more inhumanity. If the inhumanity thesis were necessarily true, we would need more human rights catastrophes to inspire more human rights progress. And that would be a self‐defeating paradox. (shrink)

In this paper we discuss the musical work of classical composer Benjamin Britten as a lasting legacy for public music education. Our starting point is the contemporary urgency to rethink both public music education in general, and the public-educational significance of Western classical music in particular, in the face of the dual threats posed by anti-educational tendencies of “functionalization” and “hobbyfication.” Relating this situation to concerns already voiced by Britten in his time, we consider in what ways aspects of Britten’s (...) musical work can be shown to reveal a highly original, post-critical answer to these threats. While his pedagogical musings remain riddled with ambiguities, which readily invite critical deconstruction, our paper argues for the more affirmative option of reconceptualizing these ambiguities as constitutive tensions of a public-educational love for (classical) music. To gauge the practical implications of such a post-critical music-educational love, we analyze the concrete case of the Aldeburgh Festival, perhaps Britten’s most full-fledged effort to reclaim music as a public affair. Thinking about this case, we reflect on how Britten’s legacy could lastingly impinge on the publicness of Western classical music, as well as on ongoing and future practices of public music education in general. In this contribution, we draw on findings from a non-formal, community music project to elaborate on the relationship between the concept ofeudaimonia, as defined by Seligman, the interactive dimensions of collective free improvisation, and the concept of collaborative creativity. The project revolves around The Ostend Street Orkestra (TOSO), a music ensemble within which homeless adults and individuals with a psychiatric or alcohol/drug related background engage in collective musical improvisation. Between 2017 and 2019 data was collected through open interviews and video (...) recordings of rehearsals and performances. Participant data was analyzed through inductive analysis based on the principles of grounded theory. One interesting finding was the discrepancy in the participant interviews between social relationships indicative of a negative affect about social group interaction versus strong feelings of group coherence and belonging. Video recordings of performances and rehearsals showed clear enjoyment and pleasure while playing music. Alongside verbal reflection through one-on-one interviews video recordings and analysis of moment-to moment observations should be used, in order to capture the complexity of community music projects with homeless people. The initial open coding was aligned with the five elements of the PERMA model. Overall, we observed more focus on Relationship (sense of belonging), Engagement (flow in rehearsals and performances) and Meaning (belonging to something greater than yourself) and less on Positive Emotion and Accomplishment (goal setting). ABSTRACT A modal logic interpretation of Dempster-Shafer theory is developed in the framework of multivalued models of modal logic, i.e. models in which in any possible world an arbitrary number (possibly zero) of atomic propositions can be true. Several approaches to conditioning in multivalued models of modal logic are presented.

Abstract:In this paper we reconceptualize general music education as a "classical music education," departing from speculative reflection on the notion of conducting. We constitute this notion as an interpretative axis connecting, on the one hand, a different perspective on what classical music might mean in the context of general education, and, on the other hand, a more dynamic, techno-ecological concept of both music and education. This paper develops these connections by thinking along with a concrete specimen of classical music in (...) the strict sense, Mahler's First Symphony, in order to show exactly how thinking about such works may actually take on an aspect that is classical in a more properly general educational sense. Beyond a dichotomy between aesthetical and praxial appraisals of the classical musical work, with their exclusive emphases on intelligible form and socio-critical praxis respectively, our idea of classical music education implies a dynamic (re)conducting of the works. Through practices of (re)conducting, music education can treat works, not as static monuments of eternal beauty or instances of socio-historical criticality, but as catalysts of self-differentiating, transhuman musical experiences—of playing, listening, composing, and thinking—in which human, instrumental, and other techno-ecological agencies mutually transform each other. The Cell Cycle Ontology (CCO) has the aim to provide a 'one stop shop' for scientists interested in the biology of the cell cycle that would like to ask questions from a molecular and/or systems perspective: what are the genes, proteins, and so on involved in the regulation of cell division? How do they interact to produce the effects observed in the regulation of the cell cycle? To answer these questions, the CCO must integrate a large amount of knowledge from (...) diverse sources; the irregularity and incompleteness of this information suggests an ontology can act as the means of this integration. The volatility and continued expansion of biological knowledge means the content and modelling of the CCO will have to be frequently changed and updated. The CCO is generated from the input data automatically once every two months. This makes it easy to change the representation to enable certain queries; incorporate new knowledge; and consistently apply design patterns across the CCO. The automatic process also allows the CCO to be delivered in a variety of representations that suit the needs of various CCO customers and the abilities of existing toolsets. In this paper we present the CCO and its characteristics of utility and flexibility, that, from our perspective, make it a beautiful ontology. (shrink)

We introduce the notion of a dice model as a framework for describing a class of probabilistic relations. We investigate the transitivity of the probabilistic relation generated by a dice model and prove that it is a special type of cycle-transitivity that is situated between moderate stochastic transitivity or product-transitivity on the one side, and Lukasiewicz-transitivity on the other side. Finally, it is shown that any probabilistic relation with rational elements on a three-dimensional space of alternatives which possesses this particular (...) type of cycle-transitivity, can be represented by a dice model. The same does not hold in higher dimensions. (shrink)

We introduce two extreme methods to pairwisely compare ordered lists of the same length, viz. the comonotonic and the countermonotonic comparison method, and show that these methods are, respectively, related to the copula T M (the minimum operator) and the Ł ukasiewicz copula T L used to join marginal cumulative distribution functions into bivariate cumulative distribution functions. Given a collection of ordered lists of the same length, we generate by means of T M and T L two probabilistic relations Q (...) M and Q L and identify their type of transitivity. Finally, it is shown that any probabilistic relation with rational elements on a 3-dimensional space of alternatives which possesses one of these types of transitivity, can be generated by three ordered lists and at least one of the two extreme comparison methods. ArgumentThis paper aims at contributing to the ongoing efforts to get a firmer grasp of the systematic significance of the entanglement of idealism and empiricism in Helmholtz's work. Contrary to existing analyses, however, the focal point of the present exposition is Helmholtz's attempt to articulate a psychological account of objectification. Helmholtz's motive, as well as his solution to the problem of the object are outlined, and interpreted against the background of his scientific practice on the one hand, and that of (...) empiricist and (transcendental) idealist analyses of experience on the other. The specifically psychological angle taken, not only prompts us to consider figures who have hitherto been treated as having only minor import for Helmholtz interpretation (most importantly J.S. Mill and J.G. Fichte), it furthermore sheds new light on some central tenets of the latter's psychological stance that have hitherto remained underappreciated. For one thing, this analysis reveals an explicit voluntarist tendency in Helmholtz's psychological theory. In conclusion, it is argued that the systematic significance of Helmholtz's empirico-transcendentalism with respect to questions of the mind is best understood as an attempt to found his empirical theory of perception in a second order, normative account of epistemic subjectivity. Nineteenth-century scientist Hermann von Helmholtz’s peculiar wavering between empiricism and transcendentalism in his philosophy of science in general, and in his theory of perception in particular, is a much debated and well-documented topic in the history and philosophy of science. This contribution aims at providing a fresh angle on this classical issue, by considering Helmholtz’s account of differential consciousness against the background of a centuries-old philosophical debate between the empiricist tradition and the tradition of transcendental idealism. By placing Helmholtz’s psychology (...) against the background of a historical narrative stretching from Hume to Fichte, one can gain insight into the possible merits of his empirico-transcendentalism with regard to the problem of differentiation. More particularly, it is argued that Helmholtz’s psychology tilted towards transcendentalism when met with the classical theoretical problems of strict empiricism in dealing with the foundation of consciousness, most notably circularity and infinite regress. Without claiming that Helmholtz’s theorizing presented a self-conscious attempt to overcome the latter issues, his well-known wavering between perspectives in general, and his appropriation of the a priori in particular, might have served him well in avoiding the deadlocks of empiricism. As noted at the end, however, Helmholtz’s account produced complex philosophical problems of its own. (shrink)

BackgroundIn our globalizing world, caregivers are increasingly being confronted with the challenges of providing intercultural healthcare, trying to find a dignified answer to the vulnerable situation of ethnic minority patients. Until now, international literature lacks insight in the intercultural care process as experienced by the ethnic minority patients themselves. We aim to fill this gap by analysing qualitative literature on the intercultural care encounter in the hospital setting, as experienced by ethnic minority patients.MethodsA systematic search was conducted for papers published (...) between 2000 and 2015. Analysis and synthesis were guided by the critical interpretive synthesis approach.ResultsFifty one articles were included. Four dimensions emerged, describing the intercultural care encounter as a meeting of two different cultural contexts of care, in a dynamic and circular process of balancing between the two cultural contexts, which is influenced by mediators as concepts of being human, communication, family members and the hospital’s organizational culture.ConclusionsThis review provides in-depth insight in the dynamic process of establishing intercultural care relationships in the hospital. We call for a broader perspective towards cultural sensitive care in which patients are cared for in a holistic and dignity-enhancing way. (shrink)

Objectives: Childhood cancer is a life-threatening disease that poses significant challenges to the life of the diagnosed child and his/her family members. Based on the ABCX-model, the aim of the current study was to explore the association between family functioning, cancer appraisal and the individual adjustment of patients, parents and siblings. Method: Participants were 60 children with leukemia or non-Hodgkin lymphoma, 172 parents and 78 siblings (115 families). Time since diagnosis varied from zero to 33 months. Patients, parents and siblings (...) completed the Family Environment Scale, Perceived Stress Scale, Situation-Specific Emotional Reactions Questionnaire and Pediatric Quality of Life Inventory/Maudsley Marital Questionnaire. Results: Family functioning and the appraisal of the cancer diagnosis proved to be related to patients’, parents’ and siblings’ cancer-related emotions and quality of life post-diagnosis. In addition, family members differed in their perception of some family functioning domains, the appraisal of the cancer diagnosis, positive feelings and quality of life. Discussion: Our findings led to the conclusion that family functioning and the appraisal of the cancer diagnosis are important for the individual adjustment of patients, parents and siblings when facing a diagnosis of cancer in the child. Differences across members within one family speak to the need of screening all family members and intervening at the level of the family unit. (shrink)

Objectives: Pediatric cancer is a life-threatening disease that poses significant challenges to the life of all family members (diagnosed child, parents, siblings) and the family as a whole. To date, limited research has investigated family adjustment when facing pediatric cancer. The aim of the current longitudinal study was to explore the predictive role of protective factors at the individual (parental psychological flexibility), intrafamilial (dyadic coping) and contextual level (network support) in explaining family adjustment as perceived by parents of children with (...) leukemia or non-Hodgkin lymphoma. In addition, we were interested to see whether these protective factors could be predictive for family adjustment at a later time point. Method: Participants were 70 mothers and 53 fathers (80 families) of children with leukemia or non-Hodgkin lymphoma. Mean time since diagnosis was 5.26 (T1) and 18.86 (T2) months post-diagnosis. Parents completed the Acceptance and Action Questionnaire II (to assess psychological flexibility), Dyadic Coping Inventory, a network support questionnaire, Impact on Family Scale and the Family Adjustment Scale. Both concurrent and prospective association models were tested. Results: Psychological flexibility, dyadic coping and network support proved to be cross-sectionally and positively related to parents’ perception of family adjustment post-diagnosis; psychological flexibility and dyadic coping proved to predict better family adjustment over time. Conclusions: Our findings led to the conclusion that protective factors at all three levels (individual, intrafamilial and contextual) are important for explaining family adjustment as perceived by parents facing a diagnosis of cancer in their child. Interventions targeting the individual, couple, as well as family level are warranted to enhance family adjustment. (shrink)

The Twelve Member States agreed in December 1991 in Maastricht on an EconomicMonetary Union, including a single currency and an autonomous European central bank by the turn of the century, and on "an ever closer union among the peoples of Europe". The structure of the European Political Union resembles a temple with three pillars : more powers for the European Parliament on a wider ranger of policy issues, a separate framework for a common foreign and security policy, and intergovernmental cooperation (...) on justice and internal aff airs. The new Treaty wilt replace the Treaty of Rome only after ratification in all twelve member states. White EMU and EPU dominated the public agenda, the internal market programme was drawing to a close with nearly all White paper measures adopted. Emphasis shifted to implementation problems. The prolonged conflict between Commission, Parliament and Council on the 1992 budget gave a taste of increasing tensions on budgetary issues, especially between "northern" and "southern" interests. That divide wilt deepen with or without ratification of the Maastricht Treaty. The budgetary battle of 1991 was partly on external relations. The external activities of the EC were all but successful in 1991: disparate conduct in the Gulf War, failure to contain conflict in Yugoslavia, near-collapse of negotiations with the EFTA countries, deadlock in Gatt-talks and the threat of a trade war between the three trade blocks. Ibe European Common Agricultural Policy remained a major stumblingblock in the Gatt-talks. The Commission proposed a radical reform package for CAP, fiercely opposed by France until the end of the year. (shrink)

The democratic revolutions in Eastern Europe, the speedy unification process of the two Germanies, growing economic disarray in the Soviet Union and the Gulf War put great pressure on the European Community - and raised high expectations throughout 1990. The external challenges initially seemed to slow down the internal integration process. But by the end of 1990 the Twelve committed themselves to further European political union and European economic union culminating into a central bank and a common currency. The two (...) intergovernmental constitutional conferences on EPU and EMU were installed on December 15. The execution of the internal market programme is on schedule with 70% of the directives adopted by late 1990, although the Commission expressed concern about timely transposition of the directives into national law. The EC's record on external relations is mixed : appreciation for its stepped-up cooperation with Eastern Europe, criticism for its tough stand on agriculture at the Gatt-conference, weak diplomatie performance during the Gulf War. This paper has two objectives. The first is to formulate a critique of present-day cognitive linguistics concerning the inner workings of the cognitive system during language use, and the second is to put forward an alternative account that is inspired by the phenomenology of Merleau-Ponty. Due to its third-person methodology, CL views language use essentially as a problem-solving activity, as coping with two subproblems: the problem of minimum and maximum, which consists in selecting the appropriate expression out of an unlimited (...) multitude of possibilities, and the problem of the underdetermination of signification. This approach presupposes a notion of an isolated subject and a representationalist view of perception. We defend an alternative view of man's relation to the world in which intersubjectivity is constitutive of embodied subjectivity and which exchanges the representationalist view of perception for a direct nonrepresentationalism. We describe the ensuing view of linguistic action as intra- and interpersonal “all-at-onceness.” This approach dismisses the two subproblems CL implicitly identifies as constitutive of language use. The first is countered by rethinking what it means to be a situated speaking subject and results in the concept of “style.” The second is tackled by opposing the concept of “overdetermination” to CL's notion of underdetermination. The classical "western" model of modernization assumes that economie development in the end will lead to a more uniform world of political democracies in free market economies. However, this western model turns out to be too deterministic for non-western countries.A selective review of the theoretical and empirical literature on the question learns that the western model runs into problems because it does not make a clear distinction between preconditions for political democratization and demands posed by modernization. Empirical studies show, contrary (...) to the western model logic, that there is no direct positive relationship between economie growth and political democratization. Cultural and structural thresholds may inhibit democratization : an intolerant culture, absence of a free market economy, external influences, a history of constantly wavering political regimes. As concerns the demands posed by modernization, modern political regimes tend to develop common characteristics, one of them being the design ofmore participatory structures and procedures. But there is no theoretical evidence whatsoever of the western model being the final destination for all modernizing societies. (shrink)

In 2008, Dutch anti-Islam Member of Parliament Geert Wilders produced a short video called Fitna to visualize his argument that Islam is a dangerous religion. Thousands of men and women across the globe uploaded their own videos to YouTube to criticize or support the film. In this article, we look at these alternative videos from a feminist perspective, contrasting the gender portrayal and narratives in Fitna with those in the alternative videos. We contend that Fitna expressed an extremist Orientalist discourse, (...) in which women are presented as the current and future victims of the oppression of Muslim men and Islam. In contrast, the YouTube videos give voice to women themselves who come from across the globe, are relatively young and often active Muslims. Second, they express different view points in generically new ways, criticizing and ridiculing Wilders or producing serious and committed explanations of their own understanding of Islam. Third, although relatively few women appeared in the videos, those that did speak for themselves, not only take on Wilders, but also claim their right to speak within Islam. We propose to understand these videos as acts of citizenships through which women constitute themselves as global citizens, in some cases by engaging in ‘deliberation’ as it is understood in feminist political theory, in other cases by taking a ‘voice’ that can be responded to. In this exploratory study, we present findings from semi-structured interviews with 11 self-identified lesbian and gay (LG) humanitarian aid workers of Doctors without Borders (MSF). We investigate their perceptions of workplace inclusion in terms of perceived satisfaction of their needs for authenticity and belonging within two organizational settings, namely office and field. Through our combined deductive and inductive approach, based on grounded theory, we find that perceptions of their colleagues’ and supervisors’ attitudes and behaviors, as well as organizational inclusiveness practices (...) play a role in LGs’ perceived authenticity, but not belonging, in the workplace. However, these organization-level characteristics do not account for between-participant differences in perceived authenticity. Therefore, we inductively construct a typology of three groups, which we coined conscious first-missioners, authentic realists, and idealistic activists, based on how LG humanitarian aid workers assess and deal with not being able to be their authentic selves when they are in the field, because homosexuality is illegal in many project countries. Conscious first-missioners are separated from the other two groups based on having gone to the field once, whereby they felt in control over the decision on how to manage their sexuality. Alternatively, authentic realists and idealistic activists alike felt they did not really have a choice in how to manage their sexuality, but handled that differently. We find the importance of one’s sexuality as well as adherence to the overarching organizational mission relevant individual-level factors herein. Furthermore, we find disclosure of sexual identity to be strongly context-dependent, as participants are ‘out of the closet’ in the office, but go back into the closet when they enter the field, with different country contexts even leading to different decisions concerning self-disclosure, thus demonstrating the importance of careful sexual identity management. This so-called disclosure dilemma, we find, may not be merely an individual choice, but rather a shared dilemma involving multiple stakeholders, such as the organization and fellow team members. We discuss the findings’ contributions to existing literature on LGs’ workplace experiences and implications for future research on inclusion of sexual and other invisible minorities in the workplace. This article examines how weblog authors present their online gender identity, in order to establish how these modes of presentation fit into the research landscape about gender identity and computer-mediated communication. After a preliminary descriptive analysis of a sample of Dutch and Flemish weblogs, the authors conduct a qualitative content analysis of four of these `blogs'. They conclude that these weblog writers present their gender identity through narratives of `everyday life' that remain closely related to the binary gender system. I won’t, but my colleague will: referral as a solution for conscientious objections in the workplace A policy of ‘refusing and referring’ allows conscientious objectors to refrain from the action they object to, as long as they can refer to a willing colleague. This policy is often presented as a pragmatic solution to the problem of conscientious objection in the workplace. In this paper, I reflect on the merits and the shortcomings of this strategy. I will analyse the current situation (...) in Belgium and in the Netherlands (section 2), where ‘refusal and referral’ is a preferred way to deal with conscientious objections. This context serves as a touchstone for arguments about conscientious objection in the workplace. Contrary to those authors that dismiss it as merely pragmatic, I argue that referral responds to value conflicts that are unavoidable in pluralistic liberal democracies (section 3). And contrary to those who criticize it as a tactical, non-moral compromise, I argue in section 4 that it is in some cases pervaded by moral values like respect for others. Finally, in section 5 I show that referral does not necessarily clash with professional values, but that it can be problematic when it confirms patterns of discrimination. (shrink)
